How it's figured
How Florida taxes a vehicle sale

Start with the taxable price
The price plus the fees you charge on the sale (section 212.02 (opens the official site in a new tab)), less the trade-in allowance (section 212.09 (opens the official site in a new tab)). Tag and title fees stay out.

6% state tax on all of it
Florida's sales tax applies to the whole taxable price, however high it goes (section 212.05 (opens the official site in a new tab)).

County surtax on the first $5,000
The county's surtax applies only to the first $5,000 of a single vehicle, so it can never be more than the county's rate on $5,000 (section 212.054 (opens the official site in a new tab)).

The buyer's county, not yours
A vehicle sale is taxed in the county of the buyer's address on the registration or title (section 212.054 (opens the official site in a new tab)). Selling to a buyer from the next county over means that county's surtax.

Florida sales tax questions dealers ask
Does a trade-in lower the sales tax in Florida?
Yes. When you take a vehicle in trade, the tax is figured on the price less the trade-in allowance (section 212.09 (opens the official site in a new tab)).
Whose county surtax applies: the dealership's or the buyer's?
The buyer's. Florida taxes a vehicle sale in the county of the buyer's address on the registration or title (section 212.054 (opens the official site in a new tab)), wherever your lot is.
Why does the county surtax stop going up?
Florida charges the county surtax only on the first $5,000 of a single item (section 212.054 (opens the official site in a new tab)), so on a vehicle it tops out at the county's rate on $5,000. The 6% state tax has no such limit.
Are dealer fees and tag and title fees taxed?
Fees you charge as part of the sale, like a dealer fee, are part of the sales price and are taxed (section 212.02 (opens the official site in a new tab)). Tag and title fees paid to the state aren't part of the sales price.
What if the buyer lives in another state?
The sale is taxed differently: depending on where the buyer takes delivery, it uses the DR-123 (opens the official site in a new tab) partial exemption or the HSMV 84061 (opens the official site in a new tab) out-of-state affidavit.
